SC Makes NEET Mandatory For All Institutions Including Private Minority Colleges

Reason to Make NEET Mandatory

As per the recent orders by the Supreme Court of India, NEET was made mandatory to end all types of malpractices in the medical college admission system. NEET ensures that the standard of medical education is maintained throughout the country. The Supreme Court of India said that by making NEET compulsory, mismanagement doesn’t come under the special management rights of minority institutions.

NEET Doesn’t Violate Minority Rights- SC

  • Many private unaided minority colleges had filed a petition in the Supreme Court stating that the National Eligibility cum Entrance Test (NEET) interferes with the fundamental rights and hampers their religious freedom as well.
  • Almost 76 petitions, including many reputed minority medical colleges, have challenged the imposition of NEET stating that this move will violate the fundamental rights of minority communities.
  • According to the colleges, the petitioner argued that this mandatory regulatory provision is a violation of the fundamental rights provided to minority private institutions under Article 30, which provided the right to build and administer educational institutions as per the choice.
  • But with this order, the Supreme Court also made clear that minority rights as per the constitution will not be violated by making NEET compulsory. Though the right to establish and manage educational institutions is a part of the minority rights, but the announcement to make NEET compulsory for admission to private minority colleges would not infringe with their rights at all.
  • Dismissing all the petitions filed by the minority colleges, a bench of Justices Arun Mishra, Vineet Saran, and MR Shah made clear that there will be no violation of the rights of the unaided/aided minority as per the Article 19(1), (g) and 30 read with Articles 25, 26 and 29(1) of the Constitution of India.
  • The NEET exam doesn’t not interfere with the rights of minority institutions at all.

The panel of judges also mentioned that such regulatory measures are introduced by administrative bodies in order to keep a strict watch on all the kinds of malpractices and to remove corruption from the system. The court announced that the institutions are not permitted to fall below the standards of excellence under the guise of the exclusive right of the management. Minorities are equally a part of the nation as the majority, and anything that impinges upon national interest needs to be taken care of.

Admission to Ayush Undergraduate Courses through NEET

  • The new rule applies to all the AYUSH courses as well and the students seeking admission in medical courses need to clear the NEET test. Ayush stands for Ayurveda, Yoga & Naturopathy, Unani, Siddha and Homeopathy and the courses offered under AYUSH programs have a different curriculum and the treatment lines differ from one other.
  • The candidates who want to take admission to the undergraduate AYUSH courses must appear for the National Eligibility cum Entrance Test (NEET).
  • The admissions in various UG courses offered at AYUSH will be granted be based on the scores and overall rank obtained in NEET. Important dates for NEET 2020 are given below.

Eligibility criteria for getting Admission to AYUSH UG courses

  • The candidates must be at least 17 years old as on December 31st of the application year.

  • The applicant must have completed 10+2 or studied equivalent core subjects from any recognized board. The subjects that the candidates must have studied include Physics, Biology or Biotechnology, Chemistry, and English in classes 11 and 12.

  • The Indian Nationals, NRIs, OCIs, or Foreign nationals can also appear for the AYUSH courses through the NEET exam.

  • There is no limit to the maximum number of attempts for the exam.

  • The candidates belonging to the unreserved category must have secured at least 50% marks in Physics, Chemistry, and Biology subjects while it is 40% for the OBC, ST, and SC and it is 45% for the PWD candidates.
