The Supreme Court has cancelled the order by Bombay High Court that directed NTA to take NEET 2021 re-examination for two candidates whose OMR sheets got mixed at the exam centre.
The Top court of India, Supreme Court has cancelled the Order of Bombay High Court that directed the National Testing Agency (NTA) to take a re-examination for two candidates whose NEET UG 2021 booklets & OMR sheets got mixed up by mistake at the examination centre.
Over 16 lakh candidates had appeared for the NEET UG 2021 exam and the qualified candidates are now waiting for the start of the counselling by the Medical Counselling Committee (MCC).
The NEET 2021 exam for UG Level was conducted successfully on September 12 for which results were expected to be out by the last week of October, but this OMR Mixing case had delayed the results. The reason being that Bombay High Court also ordered NTA to hold the results of all NEET 2021 candidates till this problem gets solved.
However, when NTA approached the Supreme Court for this results hold order, SC directed NTA to release the results for all other candidates which was later released on November 01, 2021.
Now, the Supreme Court has ordered that no re-test will be organised for the students whose OMR sheets got mixed. NTA has also sent an apology letter that reads,"We were doing duty for the first time; we assure this happened in a hurry and not a deliberate mistake." The court said that it sympathises with the plight of the candidates,but the decision could set a pattern to re-conduct the NEET exams.
The Supreme Court bench consisted of Justices BR Gavai and L Nageswara Rao who said that ordering the NTA to hold the re-exam for two students would lead to various applicants coming forward & asking for “a re-exam for one mistake or the other,” every year.
The lawyer of the students argued to conduct the exam again but the court declined to hold the re-exam for the two candidates.
