JEE Main 2023: Bombay HC to hear Exam Postponement Petition Today

New Delhi:  JEE Main 2023 postponement plea was heard in the Bombay High Court today, January 4, 2023. Students must note that the case has now been adjourned and the next hearing has been scheduled for January 10, 2023.

A division bench of Justice S V Gangapurwala and Justice Sandeep V Marne have asked the petitioner to submit relevant evidences within January 10, 2023.

Anubha Srivastava Sahai, a campaigner, filed this complaint against the National Testing Agency (NTA). According to the petitioner, the class 12 students' practical exams, vivas, and other assessments will take place in January, which will fall during the JEE Main 2023 January session. 

He claimed that the January examination of Joint Entrance Examination (JEE) Main to be conducted from January 24 to 31 was unfair to class 12th students. However, the examination authorities claimed otherwise and called the petition misleading. She further stated in her petition that notification for the exams was announced on short notice hence causing inconvenience to students.

Earlier, the first hearing of the exam postponement plea was filed on December 26, for rescheduling the JEE Main 2023 examination. 

The National Testing Agency (NTA) has also been urged to eliminate the 75% eligibility requirement in the JEE Main 2023 Exam by the Public Interest Litigation (PIL).

For the students in class 12, the exam schedule would be chaotic because even the HSC, CBSE, and ICSE (class 12) exams are set to start on February 1.

Further, the PIL has urged the authorities to remove the 75% requirement because "the marks scored by them is not a true reflection of their actual ability. 

Therefore, those students with less marks than the eligibility criteria (75%) for this year's examinations can score very high marks in the upcoming JEE Main 2023, and if the 75% requirement is removed, those students will be disqualified from the programme.

The first session of JEE Main is set to start on January 24, while its second session will start on April 6. Candidates asking for the exam to be delayed claim that not enough time was given between the notification's release and the start of the exam session, as well as the fact that JEE 2022 counselling was concluded in November. The National Testing Agency (NTA) published the JEE Main 2023 announcement on December 15.

According to the reports, the petition also requests a reduction of the eligibility requirement of 75% marks on the Class XII or equivalent exam. The COVID-19 pandemic's effects on students led to a relaxation of the requirement last year. However, it has since been restored. Students contend that this disadvantages them. 

The petitioner sought deferment and negotiations with the relevant educational boards, that the JEE exam be postponed until April 2023 or to any other convenient period.
