The Supreme Court has directed the Central Board of Secondary Education (CBSE) affiliated schools to release the detailed result and result committee’s evaluation criteria for the preparation of Class 10th, and Class 12th results for students.t

As per the statement made by the Supreme Court on August 05, 2021, schools affiliated with CBSE are asked to publish the detailed result for Class 12th, and Class 10th in order to offer transparency in result evaluation by the resulting committee. 

With the release of publishing detailed results of CBSE Class 12th and 10th students tabulated by the Results Committee of CBSE affiliated schools, students who are concerned regarding their marks will be able to decide if they wish to appear for improvement examinations. 

In accordance with Bench's directions, CBSE has already agreed to the request of releasing the detailed results. Schools affiliated with CBSE have now been notified of the same. “This shall be the responsibility of the concerned school where the students were pursuing their studies,” the order said.

As per the latest updates, the Central Board of Secondary Education (CBSE) has released the examination schedule for improvement examinations for Class 12th students. CBSE Class 12th Improvement Exam 2021 is now scheduled to be held from August 15 to September 15, 2021. 

CBSE reported to the court that improvement examination results will be prepared and released for all students to check by September 30, while the Council for Indian School Certificate Examination (CISCE) will release the result for the same by September 20.

The Supreme court's decision was made after considering the petition filed by the Association of Private Schools of Uttar Pradesh. In the petition, the Association has requested early dates for improvement exam commencement from the board.

Apart from the improvement exam early date request, the association also requested the CBSE to refund the examination fee charge of ₹1,500 for Class 12th Exam 2021 since no examination was held this year due to the ongoing pandemic. 

Referring to the same, the bench said, “On instructions, CBSE has submitted that it will issue instructions to all the schools registered under that Board to notify the internal assessment marks, the highest average in the preceding three years and the marks assigned by the Result Committee on case to case basis".

"That shall be the responsibility of the concerned school(s) where the students are pursuing studies,” the bench further added.

Earlier, the Association of Private Schools of Uttar Pradesh has raised their concerns on how students were graded with marks, and how marks were reduced in the result. 

The questions were raised due to the CBSE's rationalization policy on which students were awarded with marks based on the school’s best performance in the past three years.

Answering the questions on refund of fee, CBSE controller of examinations Sanyam Bhardwaj said, “The respondent CBSE has not unjustly enriched itself by collecting examination fees which have and is being utilized by it for the purpose of conducting examination and also for the purpose of rendering various services (mark sheet, pass certificate) to students".

"The CBSE will not be charging any additional fees for the students taking the improvement examination,” Bhardwaj said in an affidavit.

Ravi Prakash Gupta, who is representing the association said, “As per our estimates, CBSE has saved ₹200 crores by not holding a physical examination. This money can be either refunded or be used to finance mobile phones for poor students".

Answering the same, Bench added, “We don’t need your suggestions. Tell us if you have a legal right to get a refund". 

The judge further stated that examinations for CBSE students were canceled at the last minute, and the board had already made all the preparations for the same till then. 

While the exams were canceled, the CBSE had to set up a result committee, which included a total of five members for class 12th result evaluation, and seven members for class 10th. The budget for the same cost around ₹40 crores to CBSE, CBSE officials informed the court.
