Bombay HC Rejects Plea Seeking Rescheduling of JEE Main 2023 (January) Exam, Next Hearing on February 21

New Delhi: As per the latest update, the Bombay High Court has rejected the plea seeking rescheduling of JEE Main (January) 2023 Session 1 exam. The court said the postponement of the IIT JEE January 2023 exam will have a cascading effect on upcoming exams as well.

As per the Bombay High Court, lakhs of students are preparing to appear for JEE Main January 2023 examination which will be held between January 24 to January 31, 2023. The next hearing on this matter is scheduled for February 21, 2023.

Informing about the HC's decision, the bench of Acting Chief Justice (ACJ) SV Gangapurwala and Justice Sandeep Marne said, "If any orders are passed today directing postponement of January exams, the same may have a cascading effect on future exams also".

"The extraordinary circumstances do not appear to exist to restrain respondents from holding the January 2023 examination. Lakhs of students must have been preparing for the exam". he further added.

The petition to request the rescheduling of JEE Main January 2023 examination was earlier filed by Anubha Srivastava Sahai challenging a notification issued by NTA regarding the JEE Main 2023 schedule. He urged the authorities to reschedule the exam for April 2023 instead.

Advocate Joseph Thate, who represented Sahai said, JEE Main 2023 dates have been announced on short notice and the dates are clashing with Class 12th exams. Students who have registered for JEE are preparing for their pre-board and several other state board examinations.

Normally the schedule for entrance examinations like JEE is announced at least three to four months before the exam date. However, in the case of JEE Main January 2023 exam, the dates were released on December 15, 2022, giving less time to students for preparation.

In his statement, Advocate Joseph Thate shared, "The schedule was declared in December 2022 and hardly 40 days' time is accorded. Through an exam in April is another opportunity, still each and every attempt is counted".

After hearing the plea, the bench declared, "Your PIL may affect 50,000 students, but not affect 5 lakh students. A Supreme Court judgment says that even if an educational policy is not good, the courts ought not to intervene. In educational matters, judicial review is negligible".
