Bombay High Court ordered the National Testing Agency (NTA) to conduct NEET 2021 again for two candidates- Vaishnavi Bhopali and Abhishek Kapse. These 2 candidates alleged the receipt of wrong booklets and answer sheets during NEET 2021 exam conducted on September 12. In response to this order, NTA filed a plea in SC regarding the delay in the announcement of NEET 2021 Result and further admission process due to the HC verdict. In the SC hearing held today, i.e. Oct 28, NTA has been allowed to release the results.
NEET 2021 Result: Latest Update
Based on the plea filed by NTA, the Supreme Court has put a stay on the Bombay HC order for re-exam. Hence, as per the latest update from the Supreme Court hearing today, NTA is now free to release NEET 2021 Results for all candidates. The next date for the hearing has been fixed to Nov 12, to discuss the matter of NEET 2021 re-exam for the 2 candidates.
The SC bench said, ‘We will issue the notice and stay the HC order, you can release the results as there are 16 lakh medical aspirants eagerly waiting for their results, we will see later what we can do for these 2 students’.

NEET 2021 Result: NTA Plea in SC
NTA had filed a plea in SC against the Bombay HC order on grounds of delay in declaration of NEET 2021 Result. In its appeal, NTA mentioned that it can not declare the result of 16 lakh candidates even if it is ready to announce the same due to this petition. The authority further added the point of delay in UG medical admissions for the academic year.
NEET 2021: Details of Bombay HC Petition Filed by the Candidates
Bhopali and Kapse contacted the high court on September 24, 2021, through advocate Pooja Thorat seeking directions to NTA to re-examine them by holding a separate test.
- The two candidates stated that when they appeared for NEET 2021 at Shree SwamiNarayan Gurukul International School at Solapur on September 12, the invigilators gave the booklets to the candidates 5 minutes late.
- They even added that the invigilators mixed up the booklets and sheets. While Bhopali received a test booklet of Code 04 and an answer sheet of Code P4, Kapse got a test booklet of Code P4 and an answer sheet of Code 04.
- They had pointed out the discrepancy then and there, however, they were silenced and threatened with dire consequences.
- The petitioners said they tried to reason out with the examiners to provide them with matching booklets and sheets by pointing out that it would result in a complete non-evaluation of their answer papers. However, the invigilators did not rectify their mistake. Also Check NEET 2021 Paper Analysis
NEET 2021: Bombay HC Decision for Re-exam
- Advocate Pooja Thorat pointed out clause 7 of the Test Booklet Code for NEET which mandates the invigilator to rectify the mistake and provide the correct test booklet and answer sheet to the student concerned.
- She also pointed out that subsequently, the school and its principal admitted the mix-up in his communication with NTA officials, stating that it was an unintentional mistake and called upon the testing agency to help the two students.
- NTA, however, informed HC through its counsel advocate Rui Rodrigues that it was unable to arrive at a solution which prompted HC to order a re-examination of the petitioners.
- These candidates will be given 48 hours of advance notice about the date of re-exam and the exam center and to declare the petitioner’s results in two weeks.
NEET 2021 Result
