JEE Advanced 2021 is scheduled to be conducted on October 3, 2021. IIT Kharagpur will conduct the exam this year. The bench which delivered the statement comprised Justices Uday Umesh Lalit, S. Ravindra Bhat, and Bela M. Trivedi. The Bench looked into the matter and after consensus, set aside a judgment of the Calcutta High Court that had removed the condition after calling it arbitrary and discriminatory in nature.

A petition was filed in Calcutta High Court after a student's application was rejected for JEE Advanced 2021. The ground for this rejection was that the student had already secured admission to IIT Kharagpur in 2020.

The condition is mentioned in criteria 5 of JEE Advanced 2021 Information Brochure. Calcutta High Court said that there is no limitation for a non-IIT to appear for the exam. However, there is a restriction on the student from IIT to give the exam. The court viewed this condition as discriminatory. 

The Supreme Court nullified the judgment of the High Court by saying that the criteria was valid and justified as the aim is to 'preserve the valuable public resource of IIT seats.' Because of this the whole idea behind classifying IITs and non-IITs is also valid and needed. It further said that all academic matters must be left to subject-matter experts and the interference of the legal world should be minimal in every possible way. 

JEE Advanced 2021 Eligibility Criteria for IITians: Who is Eligible and Who is Not?

  • Any candidate who has accepted a seat in IIT by reporting at the reporting center or previously been admitted in an IIT/ISM is not eligible to apply for JEE Advanced 2021.
  • The candidates whose admissions were canceled due to any reason are not eligible to apply for JEE Advanced 2021.
  • The candidates who have been admitted to any preparatory course in any of the IITs for the first time in 2020 are eligible to appear for JEE Advanced 2021.
  • The candidates who paid the seat acceptance fee but did not report to the center are eligible to appear for the exam.
  • The candidates who withdrew before the last round of seat allotment, OR had their seat canceled before the last round of seat allotment are eligible to appear for the exam. Also Check JEE Advanced 2021 Reservation
