The Bar Council of India (BCI) stated in an official notification that candidates who have tested positive for COVID-19 or are experiencing symptoms will not be allowed to appear for the AIBE XV 2021.

Delhi High Court has instructed the Bar Council of India(BCI) to establish standard operating procedures (SOPs) for the safe conduct of the All India Bar Examination (AIBE) during the COVID period – 19 times.

The guidelines should be released at least one week prior to the open-book examination, the court noted. The AIBE XV 2021 examination is scheduled to take place on 24 January 2021.

The decision was taken by a single bench of High Court by Justice Prateek Jalan.

The AIBE representative, Advocate Preet Pal Singh, informed the court that the AIBE XV 2021 exam would be conducted in offline mode. Furthermore, the period from 24 March 2020 to 31 March 2021 will not be considered when calculating the two-year period during which the AIBE must be cleared, he stated.

After hearing the arguments put forward by the AIBE representative, Advocate Purav Middha asked the court to direct the AIBE to issue an SOP that would take into account the COVID-19 pandemic. The court then ordered the AIBE to issue the requested SOP.

AIBE XV 2021 Exam: What Led to the Decision?

A petition was filed before the High Court by Advocate Middha, who requested that the online examination be carried out. In response to the petition, the BCI informed the court that it was not possible to conduct an online exam, given that most lawyers do not stay in metro or class-1 cities.

The BCI argued before the court that this would have a serious impact on students from these locations to take the exam properly, as there are valid concerns about internet connectivity as well as speed.
